Terms and Conditions

By using the nibchoc website, you are bound by the following terms and conditions.  If you do not agree to be bound by them, please do not use this site to purchase nibchoc.

Note that ‘you’ and ‘your’ refers to any customer who places an order for nibchoc using this site.  ‘We’ refers to Nibchoc Ltd.

 

Responding to your Order, Availability and Replacement Goods

 

  1. We will endeavour to respond to your online order within 1 working day to acknowledge receipt of your order, and in any case within no more than 3 working days.
  2. If you have selected a 'made to order' product, we will ask in our acknowledgement of your order which variety of nibchoc you would like your order made up with. If we do not get a response indicating your preference within 7 days, we will send your order in the 'Just Nibs' variety or 'Nut Nibs' variety, depending on availability.
  3. We will endeavour to send you the goods you have ordered within 7 days of your order.  We will inform you by email if it is going to take any longer than 14 days for us to send your order.  Any delays caused by UK Royal Mail may add to the delivery time and, for this reason, we cannot guarantee precisely when your order will arrive. 
  4. If the product you have ordered is not available at the time of your order, we will inform you by email within 7 working days of your order and offer you available alternative nibchoc products.  If we do not manage to arrange an alternative order for you within a reasonable time (particularly if we cannot get in contact with you), we will send you a replacement product of approximately the same value.

 

Pricing and Postage Policy

 

  1. All prices quoted on this website are in pounds sterling, and do not include VAT.
  2. Prices remain valid until changed on this website.
  3. Postage charges quoted at the online checkout are for First Class Royal Mail delivery within the United Kingdom.
  4. Subject to paragraph 7 below on bulk orders, all orders will be sent to you by First Class Royal Mail, unless you inform us in writing that you would prefer an alternative delivery method.
  5. Delivery by First Class Royal Mail guarantees compensation for delayed or lost goods in transit, on certain conditions and up to a maximum value of £34.00.  We will retain proof of postage so that you can make a postage compensation claim if your order is delayed or lost, in accordance with the terms provided by Royal Mail.  It is your responsibility to inform us within 28 days of your order if your order does not arrive, so that we can provide you with the original proof of postage.
  6. For orders over £34.00, we recommend that you take out additional insurance to protect your order in transit.  We do not accept responsibility for your order in transit.
  7. If bulk orders are placed, the normal nibchoc postage rates may not apply.  Alternative delivery means may also need to be engaged.  If we propose to use different rates or an alternative means of delivery, we will contact you within 3 working days for your approval and we will not proceed with processing your order until your approval is obtained in writing.
  8. Note that your nibchoc order may soften by the time it reaches you, especially if delayed or heated in transit.  Any softening of the product in no way impairs its quality.  We recommend that you place your order in the freezer for an hour when it arrives, and then leave it in the fridge until ready to eat.

 

Method of Payment

 

  1. You can purchase nibchoc on this site through a PayPal account, or by Mastercard, Eurocard, Visa, Delta, Electron, American Express, Switch, Maestro or Solo cards.
  2. Full details of the payment method are provided as you progress through the PayPal shopping cart.  You will have the opportunity to check, revise and cancel your order once you have entered your payment details.
  3. Note that buying nibchoc through a PayPal account has enhanced security features.

 

Returns

 

  1. If not satisfied with the goods you have ordered, you can return them to us and we will refund your payment, so long as you inform us in writing of your intention to cancel your order within 7 days of receiving it.  Please return goods in their original condition to 10A Littlegate Street, Oxford, OX1 1RL, and indicate on the invoice why you are returning the goods.  You will be responsible for any postage costs.  We will refund your purchase in the same form of payment originally used.  Please keep the goods in the fridge until you return them.
  2. If we have provided you with replacement products for any items in your order, you are entitled to return these to us at 10A Littlegate Street, Oxford, OX1 1RL, at our expense.  You must inform us in writing within 7 days of receiving your order if you intend to do this.  Please keep the goods in the fridge until you return them.  However, if you have accepted an offer of alternative nibchoc products, this will constitute a new order and the above paragraph on returns will apply.

 

Order Information

 

We will keep electronic and hard-copy information about your order on file so that we can follow up any problems with your order.  We will also keep this information for tax and marketing purposes after your purchase is complete.  It will be accessible only by the directors and employees of nibchoc, nibchoc’s accountants, HM Revenue & Customs and those contractors employed by nibchoc for its own marketing purposes.
